Terms of Service

These Terms of Service ("Terms") govern your access to and use of reclaim.sh (the "Service"). The Service is operated by GASPNTRADER ("we", "us", "our"). By creating an account, accessing, or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. What reclaim.sh is (and is not)

reclaim.sh is software (SaaS) that helps businesses detect high-intent user behavior, identify recovery opportunities, and send follow-up outreach through workflows and integrations you configure.

reclaim.sh is not:

  • an advertising agency or done-for-you outbound service,
  • a mass messaging or spam tool,
  • an automated social media engagement tool,
  • a marketplace enabling third parties to sell to customers,
  • a payment service, money transmitter, or Merchant of Record,
  • a legal, compliance, or professional marketing advisory service.

2. Eligibility and account registration

You may need an account to use the Service. You agree to provide accurate information and keep your account secure. You are responsible for all activity under your account.

We may suspend or terminate accounts that violate these Terms, applicable laws, or the policies of our payment, hosting, or infrastructure providers.

3. Acceptable use

You agree to use reclaim.sh only for lawful purposes and in a way that complies with:

  • these Terms,
  • applicable laws and regulations,
  • the terms of any third-party services you connect,
  • and the rules of any email, analytics, hosting, or payment providers you use with the Service.

3.1 Prohibited uses

You may not use reclaim.sh for any activity connected to the following categories or practices:

  • illegal, harmful, deceptive, or unauthorized activity of any kind,
  • attempting to disrupt, probe, or compromise the Service or other users' data,
  • spam, unsolicited outreach, or abusive communications,
  • harvesting emails, scraping lead lists, or sending unlawful marketing messages,
  • misleading or fraudulent impersonation in outbound communication,
  • infringing copyrights, trademarks, trade secrets, or other rights,
  • uploading or processing data you do not have the right to use,
  • using the Service in connection with unlawful regulated, prohibited, or high-risk activity.

If we detect prohibited use, we may suspend or terminate your access immediately where necessary for compliance, safety, or platform integrity.

4. Your content, data, and responsibility

4.1 Your ownership

You retain ownership of the data, events, contacts, templates, prompts, and other materials you submit through the Service ("Customer Content"). We do not claim ownership of your Customer Content.

4.2 Limited rights we need to operate the Service

You grant us a limited right to host, process, store, transmit, and use Customer Content only as needed to provide, maintain, secure, and improve the Service.

4.3 Your responsibility

You are solely responsible for:

  • the legality, accuracy, and compliance of Customer Content and outbound messages,
  • ensuring you have the rights and lawful basis to collect and use any personal data processed through the Service,
  • reviewing and approving message content, automations, and workflows before use,
  • your compliance with email, privacy, and marketing laws applicable to your business and recipients.

5. Outreach and integrations

reclaim.sh may connect with third-party tools such as analytics platforms, email providers, CRMs, and websites or CMS tools you configure.

Your use of third-party services is governed by their own terms. We are not responsible for third-party outages, API changes, suspensions, deliverability issues, or losses caused by those third parties.

6. Data storage and backups

We store and process data to provide the Service. While we take reasonable steps to operate reliably:

  • the Service may experience interruptions, delays, or bugs,
  • we are not responsible for loss of data caused by outages, force majeure, or third-party failures,
  • you are responsible for maintaining backups of any critical content or business data.

7. Billing and payments

reclaim.sh may offer free and paid plans. If you purchase a paid subscription, you agree to pay all applicable fees shown at checkout.

Payments may be processed by Paddle or another third-party payment provider acting as Merchant of Record or payment processor. Where Paddle acts as Merchant of Record, your transaction is subject to Paddle's Buyer Terms, Paddle's Refund Policy, and related checkout terms presented during purchase.

8. Refunds and cancellations

Refunds, withdrawals, and subscription cancellations are subject to the terms presented at checkout, the policies of the payment provider or Merchant of Record, and applicable law.

If Paddle processes your transaction, Paddle's Buyer Terms and Refund Policy will apply in addition to any mandatory consumer rights that apply under law.

9. Suspension and termination

We may suspend or terminate your access if you:

  • violate these Terms,
  • use the Service in a way that creates legal, operational, fraud, or reputational risk,
  • harm the Service, other users, or third parties,
  • fail to pay applicable fees.

Upon termination, your right to use the Service stops immediately.

10. Disclaimer of warranties

reclaim.sh is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose.

We do not guarantee message delivery, inbox placement, conversion rates, revenue outcomes, or that the Service will be uninterrupted or error-free.

11. Limitation of liability

To the maximum extent permitted by law:

  • we are not liable for indirect, incidental, special, consequential, or punitive damages,
  • we are not liable for lost revenue, lost profits, lost data, missed opportunities, deliverability issues, or claims arising from content, automations, outreach, or integrations used through the Service.

12. Changes to these Terms

We may update these Terms from time to time by posting the updated version on reclaim.sh. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
